One recent case warms the heart of any litigator seeking fair treatment for his clients and justice from the courts. The Hawaii Supreme Court recently reaffirmed that attorneys' fees and costs can be recovered both in the trial court and on appeal in cases when a successful plaintiff establishes injuries from an unfair method of competition or an unfair business practice under HRS section 480-2. Gurrobat v. HTH Corporation, Sup. Ct. Appeal No. 12-0000764 (March 27, 2015). Such holdings prevent large businesses and insurers from 'winning' cases against employees and customers by burying their opponents with attorneys' fees and litigation costs.
